Sears failed to replace my refrigerator for a month, can i filed a food and damages claim?

I brought a Samsung refrigerator in October, it broke down in the end of March. Tech1 came and said the refrig need to be plugin inorder for him to fix. Tech2 came and order parts. Tech3 install the part. Tech4 said part is not working, we need a new frig. The whole process dragged out til, now May 1st and I am still waiting for a call to confirm when my new replacement will be deliver. Called many times to expedite the process instead of waiting for “unknown department-who only make outbound calls” to call me back. Long story short, do sears covers food damages?

  1. Master Protection Agreements cover $250 annually in failure-related food loss. Manufacturer warranties (which is all you'd be entitled to without a Master Protection Agreement) cover manufacturer defects only and do not cover "incidental damages," including, but not limited to, food loss due to appliance failure.
